Understanding Bail bonds:
Your Guide to Securing Release
1
Arrest
When a person is arrested they are taken into custody by law enforcement officials.
2
Booking
During the booking process, the person’s personal information and the details of the alleged offense are recorded. This includes taking fingerprints, photographs, and conducting background checks. At this time typically a bail amount is given. This is an amount based on various factors, including the seriousness of the crime and the flight risk of the individual.
3
Payment
Once bail is set, the person has the option to pay the full bail amount in cash to the court. However, many people find it difficult to come up with the entire bail amount, which leads them to seek the services of a bail bondsman.
4
Bail Bondsman
A bail bondsman is a licensed individual or company that provides a surety bond to secure the release of the arrested person. The bail bondsman charges a nonrefundable fee, usually a percentage of the total bail amount (typically 10%), which is known as the premium.
5
Paperwork
The representative, friend, or family member of the arrested person will need to complete the necessary paperwork with the bail bondsman. This includes signing a contract and providing collateral (if necessary), to secure the bond
6
Release
Once the paperwork and payment are complete, the bail bondsman will post the bail bond at the jail, guaranteeing the appearance of the person in jail to the court. The jail will then release the arrested person from custody.
7
Obligations
The person released on bail must comply with certain obligations, such as attending all court hearings and not engaging in any illegal activities, Failure to meet these obligations can result in the bail being revoked and the person being returned to custody.
8
Conclusion
The bail bond remains in effect until the case is resolved in court. If the person appears in court as required the bail bond will be exonerated and the collateral (if any) will be returned. However if the person fails to appear, the bail bondsman may hire a bounty hunter to locate and apprehend the person and the collateral may be forfeited as well as extra fees may be incurred.
